These Terms of Service (“Terms”) represent a legally binding agreement between you (“User” or “You”) and Gas2Go Inc. (“Gas2Go,” “we,” or “us”), a business operating in Alberta, Canada.
1. User Acceptance
By using our website, mobile application, or any related services (the “Service”), you agree to be bound by these Terms and our Privacy Policy. Please review both documents carefully before using our Service. If you do not agree, you may not use the Service.
2. Modifications to Terms
Gas2Go may update or modify these Terms from time to time. Changes may reflect the introduction of new features, updates in the Law, or operational adjustments. If changes are material, we will notify you via email or prominent notice on our website. Continued use of our Service after such modifications constitutes your acceptance of the updated Terms.
3. Nature of the Service
Gas2Go delivers fuel directly to registered vehicles at the user’s location, either as part of a monthly membership or via a one-time delivery. By using our Service, you authorize Gas2Go personnel to access your vehicle’s fuel tank to complete the refueling process safely and professionally.
4. Privacy and Data Use
We are committed to protecting your privacy and handling your data responsibly. Please refer to our Privacy Policy for details on what data we collect and how we use it, in compliance with Canadian privacy laws, including PIPEDA.
5. Account Creation and Security
To access our Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and any activity that occurs under your account. If you suspect unauthorized use, please contact us immediately.
6. Membership and Payment Terms
Gas2Go offers recurring membership plans with automatic monthly billing. By subscribing, you authorize recurring charges to your selected payment method. You may cancel your membership at any time through your account dashboard. Non-members can order one-time deliveries for a separate fee. All transactions are processed securely via [Square or other provider], and applicable sales taxes(e.g., GST) are included as per Canadian Law.
7. Third-Party Services
Gas2Go may integrate with third-party tools (such as social sign-ins or payment processors). Your use of those tools is governed by the third party’s own terms and privacy policies. Gas2Go is not responsible for any issues arising from third-party services.
8. Intellectual Property
All content provided by Gas2Go, including logos, text, visuals, and software, is the property of Gas2Go or its licensors and is protected by Canadian intellectual property laws. You may not copy, distribute, reverse-engineer, or misuse any part of our platform.
9. User-Generated Content and Links
Our platform may contain links to third-party websites or user-submitted content. We do not review or endorse such content and are not responsible for its accuracy or legality. Accessing third-party links is at your own risk.
10. Warranties and Disclaimers
Gas2Go provides its Service “as is” and “as available.” We do not guarantee uninterrupted or error-free Service. To the extent permitted by Law, we disclaim all implied warranties and conditions, including merchantability and fitness for a particular purpose.
11. Limitation of Liability
Gas2Go will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability under any circumstance is limited to the amount you paid us in the past 3 months. This limitation applies to the fullest extent permitted by Alberta and Canadian Law.
12. Indemnification
You agree to indemnify and hold harmless Gas2Go from any claims, damages, losses, or legal fees resulting from your use of the Service, including any violation of these Terms or applicable laws.
13. Governing Law
These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising will be handled in the courts located in Red Deer, Alberta, unless otherwise agreed in writing.
14. Dispute Resolution
Before pursuing legal action, you agree to first attempt to resolve any dispute informally by contacting Gas2Go. If resolution is not achieved, the parties may agree to mediation or arbitration in Alberta. Gas2Go does not participate in class actions or representative proceedings.
15. Termination
Gas2Go reserves the right to suspend or terminate your access to the Service at any time for violation of these Terms or for behaviour that jeopardizes the safety or integrity of the Service.
16. Entire Agreement
These Terms, along with our Privacy Policy, constitute the entire agreement between you and Gas2Go regarding the Service and supersede any prior agreements or understandings.
